PST*Joker is a COD4 modder whose mod "X4" contained both the AC130 and Tactical Nuke features as seen in MW2.

Are you suggesting there is something in the EULA saying something along the lines of "anything you make with the SDK belongs to us (IW)"?
Whilst it could be argued that PST*Joker stole the AC130 from the SP of MW1, I believe his mod uses a model of his own creation, and the 'copyright' issue is over his IDEA of having the AC130/Tac Nuke as a PERK in his mod.
In America, anything goes when it comes to suing people.
